The agreement between us.

1. Acceptance of these terms

These Terms of Service (the "Terms") are a binding agreement between you and Future Self Labs ("Future Self Labs", "we", "us" or "our") governing your use of the Ascend mobile application, the website from which you obtained it, and any related services (together, the "Service"). By installing the app, creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it you represent that you meet these requirements and that any information you give us is accurate and yours to give.

3. The Service

Ascend is an AI-powered personal advisor. Through conversation, and with photos you choose to share, it learns your goals, location and budget and produces recommendations and plans concerning style, grooming, fitness, presence and related areas of personal growth, including suggestions for local businesses and products.

We are continually improving the Service and may add, change or remove features at any time. Where a change materially reduces something you have already paid for, we will tell you and, if you prefer, refund the unused portion.

4. Not professional advice

The Service offers guidance about personal presentation, habits and self-improvement. It is generated by artificial intelligence and, while we work hard on its quality, it can be incomplete or wrong. It is not medical, mental-health, nutritional, fitness-safety, financial or legal advice, and it is not a substitute for a qualified professional who knows your circumstances. Consult a physician before beginning any exercise or dietary program, and use your own judgment about any recommendation. You are responsible for the decisions you make and the actions you take.

5. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly at info@futureselflabs.ai if you believe your account has been accessed without permission. You may not share your account or use another person's account.

6. Purchases, credits and payment

Access to the Service, or to certain features of it, requires payment. We may offer paid features in different forms — for example credits that you spend on individual recommendations ("Upgrades"), one-time purchases, or a recurring plan. The price, what it includes and any free-trial terms are shown at the point of purchase, and by purchasing you authorize us and our payment processor to charge your payment method.

• Credits. Credits are redeemed for Upgrades within the Service at the rates shown in the app, which may differ by the scope of the Upgrade. Credits have no cash value, cannot be transferred or resold, and, unless the law where you live requires otherwise, expire 12 months after purchase. Once an Upgrade has been delivered the credits spent on it are used.
• Recurring plans. If you choose a plan that renews, it is billed in advance and renews automatically at the then-current price until you cancel. You may cancel at any time in the app or by writing to us; cancellation takes effect at the end of the current period and you keep access until then.
• Price changes. We will give you at least 30 days' notice before a price change affects a recurring plan. Changes to credit prices apply only to future purchases.
• Refunds. Except where required by law or stated otherwise in these Terms, payments are non-refundable, including unused credits and partial periods. If you believe you have been charged in error, or an Upgrade was not delivered, contact us within 30 days and we will make it right.
• Taxes. Prices exclude taxes unless stated. You are responsible for any applicable taxes.

7. Your content

"Your Content" means everything you provide to the Service: messages, goals, photos, feedback and any other material. You keep ownership of Your Content.

So that we can provide the Service, you grant Future Self Labs a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, analyze, adapt and display Your Content solely to operate, secure and improve the Service for you, in accordance with our Privacy Policy. This license ends when you delete the content or your account, except for copies retained as described in the Privacy Policy.

You represent that:

• you own or have the necessary rights to Your Content;
• any photos you upload depict you, or another adult who has given you permission to share them for this purpose;
• Your Content does not infringe anyone's rights or violate any law.

We do not claim ownership of Your Content and we do not use your photos for advertising or sell them to anyone.

8. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• upload content that is sexually explicit, depicts minors, or is hateful, harassing or threatening;
• upload photos of any person without their permission;
• attempt to extract, reverse engineer, or interfere with the models, software or infrastructure that power the Service;
• use automated means to access the Service, scrape it, or place unreasonable load on it;
• resell or commercially exploit the Service or the recommendations it produces without our written permission; or
• attempt to circumvent any security or access controls.

9. The app and direct downloads

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Ascend app on Android devices you own or control, for your personal, non-commercial use.

During our early release the app is distributed as a direct download (an APK file) from our website rather than through an app store. Download it only from Future Self Labs and verify that your device shows our name as the source before installing; we are not responsible for copies obtained elsewhere. Installing software from outside an app store requires you to change a setting on your device, which you do at your own discretion. We recommend restoring that setting afterward. When the app becomes available through app stores, the terms of that store will apply in addition to these Terms.

10. Intellectual property

The Service — including its software, models, design, text, graphics, logos and the Future Self Labs and Ascend names — is owned by Future Self Labs or its licensors and is protected by intellectual-property laws. Except for the license expressly granted above, no rights are granted to you. If you send us suggestions or feedback, you agree we may use them without obligation to you.

11. Third-party businesses and services

The Service may recommend barbers, tailors, gyms, shops, products and other third parties. These are suggestions based on the information you gave us and publicly available details. We do not operate, endorse or guarantee them, we do not receive your information from them or share yours with them, and any purchase or engagement is solely between you and that business. Prices and availability may differ from what the Service estimates.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service is no longer commercially reasonable; where practical we will give you notice and, if we terminate without cause, a refund of any unused credits or the unused portion of a paid period. Sections that by their nature should survive termination — including 7, 10 and 13 through 17 — will survive.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, FUTURE SELF LABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT RECOMMENDATIONS WILL BE ACCURATE OR SUITABLE, OR THAT YOU WILL ACHIEVE ANY PARTICULAR RESULT. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FUTURE SELF LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS (US$100). These limitations are fundamental to the bargain between us and apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify and hold harmless Future Self Labs and its officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of or related to Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

16. Governing law and dispute resolution

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Arkansas, without regard to its conflict-of-laws rules, and, where applicable, the federal law of the United States.

Talk to us first. Most concerns can be resolved quickly and informally. Before starting any formal proceeding, you agree to write to us at info@futureselflabs.ai describing the issue, and we agree to work with you in good faith for at least 30 days to resolve it.

Venue. If we cannot resolve a dispute informally, you and Future Self Labs agree that it will be brought exclusively in the state or federal courts located in the State of Arkansas, and each of us consents to the personal jurisdiction of those courts. Either party may nevertheless bring an individual claim in small-claims court where permitted.

Individual claims; jury waiver. To the fullest extent permitted by law, you and Future Self Labs each agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class, consolidated or representative proceeding, and each waives any right to a trial by jury.

Time limit. Any claim relating to the Service must be filed within one year after it arose, or it is permanently barred, unless applicable law does not allow this limitation.

17. Changes to these terms

We may revise these Terms from time to time. If a change is material we will notify you in the app or by email at least 14 days before it takes effect. The current version will always be posted here with its last-updated date. Continued use of the Service after a change takes effect means you accept the revised Terms; if you do not agree, stop using the Service before that date and cancel any recurring plan.

18. General

These Terms, together with the Privacy Policy and any terms presented at purchase, are the entire agreement between you and Future Self Labs regarding the Service. If any provision is found unenforceable, the remainder will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. Notices to you may be given by email to the address on your account or within the app. Nothing in these Terms creates a partnership, employment or agency relationship between us.
